In Belgium, every child shorter than 1.35 meters must be in an approved child seat that fits their height or weight. From 1.35 meters, the regular seat belt is sufficient. Failing to comply is a third-degree offense with an immediate fine of 174 euros.
A Child in the Front: Watch Out for the Airbag
You may transport a child of any age in the front passenger seat, as long as they are secured in the correct seat or seat belt. One strict condition: if you place a baby seat facing the rear in the front, you must deactivate the frontal airbag on that side. An deploying airbag can be fatal for the baby in the event of a collision. If you cannot deactivate the airbag, the seat must be positioned in the direction of travel.
Exceptions in the Back Seat
The law allows for a few specific situations where you may temporarily deviate:
- No space for a third seat: If there are already two child seats in the back seat and there is physically no room for a third, then a child from 3 years old may sit in the remaining seat with the regular seat belt.
- Occasional transport over a short distance: If you occasionally take someone else's child for a short ride without a suitable seat, then a child from 3 years old may sit in the back with the seat belt. A child younger than 3 years may not be transported. This exception does not apply to your own children in your own car: they must always be in a suitable seat.
Valid Approval Marks: R44/04 and i-Size (R129)
Every seat must carry a valid orange ECE label. Two standards are currently permitted:
- ECE R44/04: classified by the weight of the child.
- i-Size / ECE R129: classified by the height of the child, with mandatory Isofix.
Since September 1, 2024, only new seats sold in the EU may comply with the R129 standard. An existing R44/04 seat you already have remains allowed for use. Only the very old standards (R44/01 and /02) are no longer permitted. Always check if your child's height or weight falls within the class on the label.
